Just arrested?
What to say (and what not to say)
When you're under arrest, what you say matters — and what you don’t say can matter even more. You have the right to remain silent, and you don’t have to answer questions without speaking to a lawyer first.
You have the right to silence
You don’t have to answer questions — and staying quiet is often the safest choice.
Don’t sign or agree to anything
Police may ask you to sign statements or agree to an interview. Wait until you’ve had legal advice.
Ask for a lawyer straight away
If police start asking questions, tell them you want to speak to Pascoe Law.
Stay calm, stay quiet
Losing your temper or trying to explain things on the spot can make things worse. Let us do the talking.

What happens after an arrest
After an arrest, police will usually take you to the watch house. From there, you might be:
Released with a notice to appear in court later
Kept in custody for a bail hearing the next day
Asked to participate in an interview
If you’re charged, the first court mention usually happens within 24 hours (if you’re in custody) or on a set date (if you’re released). That first appearance matters — and it’s where a lawyer can start to shape how your case moves forward.
We can speak to police on your behalf, give you advice before any interview, and appear at your first mention to apply for bail or seek an adjournment.

Bail applications and next steps
If you’ve been refused bail by police, your next opportunity is usually in the Magistrates Court the following day. We can prepare and argue your bail application — or, if you’ve already been refused in court, look at whether a further application is possible.
We’ll also explain what happens after bail is granted, what conditions might apply, and what you need to do to avoid breaching them. From there, we’ll help you prepare for your next court date and start working on your defence.
